• Media and visual content derived from scan data

All services are provided strictly according to the scope defined in the approved quotation or written agreement. Any services not explicitly included are excluded unless agreed to in writing.

4. Quotations and Project Engagement

• All quotations are project-specific and based on information provided by the client.

• Quotations are valid for the period stated therein.

• Work will only commence once a quotation has been formally accepted and any required deposit has been received.

• Any changes to project scope may result in revised timelines and additional costs.

5. Client Responsibilities

Clients are responsible for:

• Providing accurate and complete project information

• Ensuring site access, safety compliance, and permissions

• Preparing spaces for scanning where required (clear access, visibility, and line-of-sight)

• Informing Beyond Sight of any site restrictions or sensitive areas prior to scanning

Beyond Sight is not responsible for delays or inaccuracies caused by incomplete or incorrect client-provided information.

6. Turnaround Times

Estimated turnaround times provided on the website or during discussions are indicative only. Final delivery timelines depend on:

• Property size and complexity

• Access conditions

• Selected services and deliverables

• Client feedback and approvals

Confirmed timelines will be outlined in the project quotation.

7. Intellectual Property

All LiDAR data, point clouds, models, drawings, media, and related deliverables remain the intellectual property of Beyond Sight until full payment has been received, unless otherwise agreed in writing.

Upon full payment, the client is granted a non-exclusive, non-transferable licence to use the deliverables for their intended purpose as outlined in the quotation.

Beyond Sight reserves the right to use anonymised or non-sensitive visuals for portfolio or marketing purposes unless otherwise agreed.

8. Use of Website

You agree not to:

• Use the website for unlawful purposes

• Attempt to access restricted systems or data

• Misuse or copy website content without permission

All website content is provided for general information purposes only and does not constitute professional advice.

9. Limitation of Liability

To the maximum extent permitted by law:

• Beyond Sight is not liable for indirect, incidental, or consequential damages

• Liability is limited to the total amount paid by the client for the specific service provided

• Beyond Sight is not responsible for decisions made based on delivered data or models

All services are provided on an “as-is” basis within the agreed scope.

10. Third-Party Tools and Platforms

Beyond Sight may use third-party platforms or software (such as cloud processing or viewing tools) as part of service delivery. Beyond Sight is not responsible for outages, changes, or limitations imposed by third-party providers.

11. Privacy

Personal information is handled in accordance with our Privacy Policy, which forms part of these Terms.

12. Termination

Beyond Sight reserves the right to refuse or terminate services where:

• These Terms are breached

• Payment obligations are not met

• Site conditions pose safety or operational risks

Any outstanding amounts remain payable upon termination.

These Terms are governed by the laws of the Republic of South Africa, and any disputes shall be subject to the jurisdiction of South African courts.
